Des crimes de guerre ont peut-être été commis lors des combats du mois dernier entre des militants israéliens et palestiniens dans la bande de Gaza, selon Amnesty International.
Un rapport du groupe des droits de l’homme conclut que les forces israéliennes ont mené des frappes aériennes apparemment disproportionnées qui ont tué des civils palestiniens.
Il indique également que des tirs de roquettes aveugles du Jihad islamique palestinien (JIP) ont tué des civils israéliens et palestiniens.
Amnesty demande à la Cour pénale internationale d’enquêter.
Un porte-parole du JIP a déclaré que le groupe avait salué le rapport, alors qu’il n’y avait pas eu de réponse immédiate des Forces de défense israéliennes (FDI).
Trente-quatre Palestiniens et un Israélien ont été tués lors de la dernière série de combats transfrontaliers, qui ont éclaté le 9 mai et se sont terminés cinq jours plus tard par un cessez-le-feu négocié par l’Égypte.
Cela a commencé lorsque des avions de guerre israéliens ont effectué des frappes aériennes pendant la nuit qui ont tué trois hauts commandants de la branche armée du JIP dans leurs maisons ainsi que 10 civils, dont des proches et des voisins des hommes.
Amnesty International a déclaré que le largage de bombes à guidage de précision sur des zones densément peuplées alors que les familles dormaient suggérait « que ceux qui ont planifié et autorisé les attaques ont anticipé – et probablement ignoré – les dommages disproportionnés causés aux civils ». « Lancer intentionnellement des attaques disproportionnées… est un crime de guerre », a-t-il averti.
Tsahal a déclaré qu’au cours des combats qui ont suivi, ses avions ont frappé plus de 400 cibles militaires appartenant au JIP et tué trois autres commandants supérieurs de sa branche militaire, qu’ils ont accusés d’avoir tiré des dizaines de roquettes et de mortiers sur Israël la semaine précédente.
Amnesty a enquêté sur neuf frappes, dont celles qui visaient les trois commandants du JIP à leur domicile.
Amnesty a également déclaré avoir “identifié un schéma de destruction massive de biens” à Gaza à la suite des frappes israéliennes qui “ne respectaient pas les exceptions en vertu desquelles des attaques contre des maisons et d’autres biens civils seraient justifiées”.
Il a cité le ciblage le 13 mai d’un immeuble de quatre étages dans le camp de réfugiés de Jabaliya qui abritait 42 personnes de la famille élargie Nabhan .
Amnesty n’a trouvé aucune preuve que le bâtiment ait été utilisé pour stocker des armes ou tout autre équipement militaire, ou que des roquettes aient été lancées à proximité.
“Au cours de notre enquête, nous avons entendu des récits saisissants de bombes ayant détruit des maisons, de pères extirpant leurs petites filles des décombres, d’une adolescente mortellement blessée alors qu’elle était allongée dans son lit tenant un ours en peluche”, a déclaré la directrice d’Amnesty pour le Moyen-Orient, Heba Morayef.
“Plus effrayant que tout cela est la quasi-certitude que, à moins que les auteurs ne soient tenus responsables, ces scènes horribles se répéteront.”
Le JIP a répondu aux frappes israéliennes en tirant plus de 1 400 roquettes vers Israël, forçant des dizaines de milliers de civils à se réfugier dans des abris anti-bombes.
Tsahal affirme que 1 139 personnes sont entrées en territoire israélien au total et qu’environ 430 se dirigeant vers des zones peuplées ont été interceptées par ses systèmes de défense antimissile.
Une Israélienne et un ouvrier palestinien de Gaza ont été tués par des roquettes qui ont touché respectivement un appartement à Rehovot et un chantier à Shokeda.
Amnesty affirme que les roquettes qui ont échoué à Gaza semblent également avoir tué trois civils palestiniens, dont deux enfants.
Le rapport cite des proches des enfants qui ont déclaré qu’ils étaient morts lorsqu’une roquette a touché la rue al-Sahaba dans la ville de Gaza dans l’après-midi du 10 mai.
Le JIP a nié à l’époque qu’une roquette avait touché la zone et a blâmé les frappes israéliennes, mais des témoins ont déclaré à un chercheur que des individus associés au groupe avaient enlevé les restes d’une roquette immédiatement après l’incident.
« Connues pour leur inexactitude inhérente, les attaques à la roquette par des groupes armés palestiniens sont aveugles ; ces attaques doivent faire l’objet d’une enquête en tant que crimes de guerre et les victimes doivent bénéficier d’une réparation rapide et adéquate », a déclaré Mme Morayef.
Le porte-parole du JIP, Tariq Salmi, n’a pas commenté cette allégation.
Mais il a déclaré à la BBC que le rapport d’Amnesty « prouve que l’occupation [Israël] est celle qui a commencé l’agression en commettant de graves crimes ».
“L’ennemi utilise les armes dont il dispose pour tuer des civils palestiniens et nous faisons notre part pour nous défendre contre les crimes commis par Israël contre le peuple palestinien”, a-t-il ajouté.
Israël a déclaré qu’il prenait des mesures importantes pour essayer d’éviter de blesser des civils.
